Terms of Service for Ryan Smith Drum Lessons Studio

These Terms of Service (“Terms”) govern your access to and use of the online drum lessons studio operated by Ryan Smith Music, LLC, doing business as Ryan Smith (“we,” “us,” or “our”), including related websites, Discord servers, and services (collectively, the “Studio” or “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

The Services are available only to individuals who are at least 13 years old.

  • Children under 13 are not permitted to use the Services.

  • Users aged 13–17 (“Minors”) may use the Services only with the permission and ongoing supervision of a parent or legal guardian.

  • By allowing a Minor to use the Services, the parent or legal guardian represents that they consent to the Minor’s participation and agree to be bound by these Terms on the Minor’s behalf.

We may suspend or terminate access if we believe a user does not meet eligibility requirements.

2. Description of Services

The Services provide online drum instruction, feedback, and related educational content. This may include:

  • Live or asynchronous instruction

  • Video or audio feedback

  • Access to private Discord servers or channels

  • Scheduling, communication, and instructional materials

We reserve the right to modify or discontinue any aspect of the Services at any time.

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to:

  • Provide accurate and current information

  • Use the Services only for lawful purposes

  • Not share access credentials with others

We may suspend or terminate your account for violations of these Terms or misuse of the Services.

4. Payments and Subscriptions

Payments for the Services are processed through Stripe, a third-party payment processor.

  • We do not store full payment card numbers.

  • Fees, billing intervals, and cancellation terms are disclosed at the time of purchase.

  • All fees are non-refundable unless otherwise required by law.

Failure to complete payment may result in suspension or termination of access.

5. User Content

Ownership

You retain ownership of any content you submit, including videos, audio recordings, messages, or other materials (“User Content”).

License to Us

By submitting User Content, you grant us a non-exclusive, royalty-free, limited license to use, display, reproduce, and process that content solely for the purpose of providing the Services, including instruction, feedback, and service improvement. We will not use or share any of your User Content in any way without obtaining permission from you.

We do not use User Content for marketing or advertising.

Responsibility

You are solely responsible for your User Content and represent that you have all rights necessary to submit it.

6. Discord and Third-Party Platforms

The Services rely on third-party platforms such as Discord and Stripe.

  • Your use of those platforms is governed by their respective terms and privacy policies.

  • We are not responsible for the independent data practices, outages, or policies of third-party services.

  • Access to the Services may depend on maintaining an active account with those platforms.

7. Acceptable Use

You agree not to:

  • Harass, abuse, or harm others

  • Share offensive, unlawful, or inappropriate content

  • Record or redistribute lessons without permission

  • Attempt to gain unauthorized access to systems or accounts

  • Use the Services for commercial purposes without authorization

Violation of this section may result in immediate termination.

8. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if:

  • You violate these Terms

  • You misuse the Services

  • Continued access poses legal, security, or operational risk

Upon termination:

  • Access to the Studio and Discord servers may be revoked

  • User data will be handled in accordance with our Privacy Policy

9. Disclaimers

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Ryan Smith Music, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services.

Our total liability shall not exceed the amount paid by you for the Services during the two (2) months preceding the claim.

Some jurisdictions do not allow certain limitations; in those cases, liability will be limited to the extent permitted by law.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in state or federal courts located in Texas, unless otherwise required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
